6th meeting of the advisory board of the Kraftfahrt-Bundesamt

The Advisory Board of the Kraftfahrt-Bundesamt (KBA) held its sixth meeting on 22 September 2021. Due to the ongoing Corona pandemic, the advisory board meeting was again held as a video conference.

After the welcoming address by the chairman, Prof. Lemmer, nine agenda points were discussed, which had been submitted in advance by the members of the advisory board and KBA. The topics included autonomous driving, the status of the Certificate of Conformity (CoC) database, the EU individual vehicle approvals and the national regulation on type approval and market surveillance.

KBA reported on the opening of its test laboratory in Harrislee and on the test site in Leck. The new testing possibilities were also explained in this context.

At the meeting, the advisory board members made suggestions on the user-friendliness of the annual market surveillance report and KBA's website.

As a result of the diesel emissions issue, KBA has received a large number of requests for infor-mation under the freedom of information act as well as various requests for administrative assistance from regional and higher regional courts. The Advisory Council inquired about the process and duration of administrative proceedings. KBA aims basically for an average processing time of one month as a guideline. The number of requests for administrative assistance increased by approx 380 in 2020 to more than 2000 in 2021 (as of 01.09.2021). In particular, general requests under the freedom of information act regularly require the review of extensive administrative files and therefore cause correspondingly longer processing times. KBA stated that in order to be able to deal with the high number of requests, the request should be as specific as possible and limited to the actual needs of the applicant.
