Diesel Emission Subject
- Vehicles are listed in which defeat devices categorised as prohibited or critically assessed by KBA have been ascertained. Basically, defeat devices are present in every vehicle, which are justified according to Article 5(2) of Regulation (EC) No. 715/2007.
- Only vehicles that fulfil all the characteristics named in the overview are affected.
- The designation “prohibited defeat device” indicates that the efficacy of the emission con-trol system was reduced in an impermissible way according to KBA’s assessment.
- After the approval of the technical solution by KBA the recall for establishing the compli-ance can be started by the manufacturer. This can take some time, depending on the number of affected vehicles.
- The Overview 2 is not final and is regularly updated because vehicles are still being inspected by KBA.
Since the Kraftfahrt-Bundesamt (KBA) detected prohibited defeat devices for the first time in September 2015, in the meaning of Article 5(2) of Regulation (EC) No. 715/2007, it ordered the removal of these devices for type approvals of various manufac-turers and thus the establishment of conformity in compliance with Article 25(2) of the EC Vehicle Approval Regulation (EG-FGV). This ordinance forms an auxiliary condition to the type approval, which continues to be valid. The responsibility of KBA here extends exclu-sively to those manufacturers that received their type approvals from KBA.
The implemen-tation of recalls in cooperation with other type approval authorities by KBA is carried out on the basis of Article 32 (2) Sentence 3 of Directive 2007/46/EC.

Within the scope of the since 09/2015 known Diesel Emission Subject, KBA has tested the effectiveness of software updates in terms of reduction of nitrogen oxides for diesel engines.
The presented investigation demonstrates that the implementation of software updates can lead to a significant reduction of NOx emissions without the necessity of additional hardware.
The investigation focuses on the manufacturer’s software updates. Beside the removal of potential defeat devices, the quantification of improvement in terms of real driving emissions (RDE) and emissions with low ambient temperatures were observed in detail. Through this evaluation, it is possible to determine a holistically better behaviour in terms of emissions, which is caused by mentioned software updates.

After the Volkswagen AG (VW) in September 2015 had to admit to have sold diesel vehicles with defeat devices in the US, it became public, that vehicles with prohibited software were also placed on the market in Europe. Further, it became public, that not only VW but more developers sold cars with defeat devices.
Afterwards the former minister of transport and digital infrastructure, Alexander Dobrindt, created the investigative commission “Volkswagen”. On behalf of this commission comprehensive emission measurements on more than 50 vehicles of various manufacturers were conducted, in order to identify defeat devices and prohibited systems to determine test environments and test cycles. In the following the reports of this commission are published.
Within the first report the first results in terms of nitrogen oxides (NOx) as well as determined conspicuous features with respect to defeat devices were published in April 2016. For these tests, diesel vehicles were observed.
The second report enables statements about the carbon dioxide (CO2) emissions of the observed vehicles, which displayed noticeably high CO2 emissions.
The publication of the second report of the 26th of June 2017 documented the conducted tests of vehicles, which were type approved by KBA as well as vehicles of German manufacturers, which were type approved from another European type approval authority.
In the comprehensive version of the second report from the 8th April 2020, CO2 emissions of vehicles, which were not type approved by KBA, are displayed and evaluated as well.
