If a meeting between the manufacturer and the KBA is desired prior to the application, the manufacturer will typically present the vehicle and its fully automated driving function, followed by a discussion to clarify open questions between the manufacturer and the KBA. Depending on the complexity of the project, one to two hours should be planned for this meeting.

The approval for vehicles with a fully automated driving function is the approval of one vehicle type. It can therefore cover several vehicles of the same design. However, it is also possible to obtain an individual approval.

In the context of granting a type approval for vehicles with a fully automated driving function pursuant to § 1e of the “Straßenverkehrsgesetz (StVG)”, the requirements specified in § 14 of the “Verordnung zur Genehmigung und zum Betrieb von Kraftfahrzeugen mit autonomer Fahrfunktion in festgelegten Betriebsbereichen (AFGBV)” apply to the natural person appointed as the technical supervisor.

The natural person appointed as the technical supervisor is allowed, upon approval by the vehicle owner, appoint additional natural persons in accordance with § 13 (2) of the AFGBV to comply with his / her tasks.

Generally, the assessment of the technical supervision is the task of the federal state authority responsible for the approval of the operating area and thus not the responsibility of the KBA.

The approval of an operating area within the meaning of § 9 of the “Verordnung zur Genehmigung und zum Betrieb von Kraftfahrzeugen mit autonomer Fahrfunktion in festgelegten Betriebsbereichen (AFGBV)” cannot be granted for an operating area outside the Federal Republic of Germany. The legality of the operation of nationally approved vehicles with a fully automated driving function depends on the legislation in the neighbouring country concerned. Which authority of the neighbouring country is responsible, has to be figured out by the interested vehicle manufacturer or owner.
