According to article 47 paragraph 1 of Regulation (EU) 2018/858, a completed individual vehicle manufactured in multi stages can be approved according to Article 44. Due to this, section 3.2 of annex IX of Regulation (EU) 2018/858 means for such individual approvals, that the requirements of annex I and the regulatory acts listed in annex II apply as if the individual approval would have been granted to the manufacturer of the base vehicle.

• if a test report of another member state will be submitted (annex II, Part I, appendix 2, No. 2.3 letter c of Regulation (EU) 2018/858, whether the technical service is notified by the commission.
• the maximum of vehicles per year is kept (300 for M1 and N1)

„Technische Prüfstellen für den Kraftfahrzeugverkehr“ are not part of the designation of KBA, Because of this KBA cannot control quality of checks and has no legal access to them.

Test reports from such institutions cannot be used for EU individual vehicle approvals.

The information can be transfered safe via document exchange server E-Typ.

If the documents will be sent by e-mail the sender takes the risk of this way of transfer. Additionally, it is possible that the e-mail will be rejected because of file size limits (5MB).

KBA will clarify the situation directly with the responsible technical service.

The approval will be refused for example, if

• the relevant technical or administrative requirements of Regulation (EU) 2018/858 are not fulfilled.
• the observance of the relevant technical or administrative requirements of Regulation (EU) 2018/858 could not be checked, because necessary information are missing or not submitted by technical service even after request.
• the necessary information even after request are not fulfilled by the applicant
• the max. number of vehicles is exceeded.

The responsible authority for registration asks the KBA in a case of doubt. Therefore they have to submit the counting number of the approval DEXXXX and the vehicle identification number (VIN) to EUFEG@kba.de. The asking authority and person has to be specified clearly in the inquiry.

Not approvable are

• Vehicles other than M1 and N1 according to annex II, Part I of Regulation (EU) 2018/858
• Incomplete vehicles
• Completed vehicles, which uses a base vehicle with national end-of-series approval

Approvable are

• Complete and completed vehicles of category M1 or N1
• Complete and completed vehicles of all categories, if they are special purpose vehicles

The following requirements have to be complied with:

• For category M1: Annex II, Part I, Appendix 2, Part I
• For category N1: Annex II, Part I, Appendix 2, Part II
• All categories with special purpose: Annex II, Part III

Whether a vehicle is complete or completed will be decided on vehicle category and code for vehicle body (examples for incomplete vehicles: N3 with code BC = tractor without fifth wheel; N2 with code BX = chassis cab; M3 with code CX = Bus chassis)

Vehicles with special purpose (other that M1 and N1) can only be approved according to article 44 with code „SG“ if no exemptions will be used (Annex II, part 1 will be fulfilled) and if the special purpose can be shown.

For each individual vehicle (vehicle identification number (VIN)) a test report with reference on article 44 of Regulation (EU) 2018/858 and according to annex II, part I, appendix 2, number 2.4 of Regulation (EU) 2018/858 has to be used.

The place and date of testing has to be named. The signed person has to confirm that the vehicle was tested at this place and time physically, that the description of the vehicle is correct and that the vehicle fulfills the requirements according to list of applicable regulations.

It is possible to link to another test report (for example test report for another EU individual approval) and the list of applicable regulations of this test report.

If alternative requirements according to annex II, part I, appendix 2, part I or II are used and if the regulation allows different alternatives, the chosen alternative has to be named (for example: Number 10A, 14A, 15A, 19A, 53Aund 54A)

Which national emission code has to be used if for vehicles of categories M1 and N1 alternative requirements were used?

If in 2A or 41A of annex II, part I, appendix 2, part I alternative requirements are used, the national emission code is determined according to

The national emission code is determined by technical service during vehicle test.

Please consider the following:

• For each individual vehicle (vehicle identification number (VIN)) a test report with new test report number has to be written. The place and date of testing has to be named. The signed person has to confirm that the vehicle was tested at this place and time physically, that the description of the vehicle is correct and that the vehicle fulfills the requirements according to list of applicable regulations.
• If a conformity declaration of the manufacturer or the test result of a technical service is applicable for other vehicles, a test report can be used multiple times (multi test report)
  The multi test report has to get a clear identification code. This identification code has to be named in test report as described in first bullet point and the multi test report has to be added.

Whether the technical features are „approximately“ identically will be decided by KBA in time.

For processing the starting data a fee about 59 Euro has to be paid.

The fees for granting an EU individual approval are about 396 Euro. If at the same time an „approximately“ identically vehicle should be granted, this vehicle causes a fee of 55 Euro.

If an approval has to be refused the fee is about 25 up to 75 percent of the granting fees.

Is or was the vehicle at date of application less than 6 month registrated (registrated means an unlimited, limited or short time approval by an authority to be part of the road traffic, which also includes the identification and allocation of a license plate), this can be shown by a copy of registration documents. If no registration documents are available, it can be also shown by a document about date of production or date of first sale. In this case the date of production or date of sale has to be no longer than 6 month ago.
