Granting Type Approvals

Type Approvals confirm that the legal safety and environmental standards are fulfilled.

KBA granting Type Approvals according to national and internationally agreed regulations.

The minimum standards are derived from legal acts of the European Union, the United Nations Economic Commission for Europe (UNECE) and national regulations such as the Road Traffic Licensing Code (StVZO) and the Vehicle Parts Ordinance (FzTV).

As approval authority KBA is not responsible for individual vehicle approvals with national validity and for approvals for changes done on vehicles already in traffic. For this the authorities according to state law of the different federal states are responsible.
For automated / fully automated vehicles the responsibilities are maybe different.

The kinds of approval, which differ from the generally type approval rules are summarized under "Special approvals".

Although the vehicles are approved and produced, they do not fulfil the current regulations for the vehicle registration. Despite this, and on application, a limited number of vehicles could be given a time limited approval for the vehicle registration.

The conditions for this are:

the vehicles have a Type Approval
the vehicles are in Germany
and the vehicles have valid certificates of conformity/registration documents

In EC-small series type-approvals, the manufacturer can carry out the technical testing (Article 41 in conjunction with Annex II, Part I, Appendix 1 of Regulation (EU) 2018/858). For this, the manufacturer must be designated by the KBA.

Multi-stage Type Approvals are appropriate when incomplete vehicles are to be completed, for example, with a chassis frame from a further manufacturer. Multi-stage Type Approval procedure is complex and requires good coordination between the manufacturers of the various stages.

Kraftfahrt-Bundesamt (KBA) is responsible for EU individual vehicle approvals (Regulation (EU) 2018/858 article 44).

The following information have to be sent to KBA in a readable (with activated Optical Character Recognition (OCR)) and complete package:

According to article 47 paragraph 1 of Regulation (EU) 2018/858, a completed individual vehicle manufactured in multi stages can be approved according to Article 44. Due to this, section 3.2 of annex IX of Regulation (EU) 2018/858 means for such individual approvals, that the requirements of annex I and the regulatory acts listed in annex II apply as if the individual approval would have been granted to the manufacturer of the base vehicle.

„Technische Prüfstellen für den Kraftfahrzeugverkehr“ are not part of the designation of KBA, Because of this KBA cannot control quality of checks and has no legal access to them.

Test reports from such institutions cannot be used for EU individual vehicle approvals.

The information can be transfered safe via document exchange server E-Typ.

If the documents will be sent by e-mail the sender takes the risk of this way of transfer. Additionally, it is possible that the e-mail will be rejected because of file size limits (5MB).

KBA will clarify the situation directly with the responsible technical service.

The approval will be refused for example, if

the relevant technical or administrative requirements of Regulation (EU) 2018/858 are not fulfilled.
the observance of the relevant technical or administrative requirements of Regulation (EU) 2018/858 could not be checked, because necessary information are missing or not submitted by technical service even after request.
the necessary information even after request are not fulfilled by the applicant
the max. number of vehicles is exceeded.

The responsible authority for registration asks the KBA in a case of doubt. Therefore they have to submit the counting number of the approval DEXXXX and the vehicle identification number (VIN) to EUFEG@kba.de. The asking authority and person has to be specified clearly in the inquiry.

Not approvable are

Vehicles other than M1 and N1 according to annex II, Part I of Regulation (EU) 2018/858
Incomplete vehicles
Completed vehicles, which uses a base vehicle with national end-of-series approval

Approvable are

Complete and completed vehicles of category M1 or N1
Complete and completed vehicles of all categories, if they are special purpose vehicles

The following requirements have to be complied with:

For category M1: Annex II, Part I, Appendix 2, Part I
For category N1: Annex II, Part I, Appendix 2, Part II
All categories with special purpose: Annex II, Part III

Whether a vehicle is complete or completed will be decided on vehicle category and code for vehicle body (examples for incomplete vehicles: N3 with code BC = tractor without fifth wheel; N2 with code BX = chassis cab; M3 with code CX = Bus chassis)

Vehicles with special purpose (other that M1 and N1) can only be approved according to article 44 with code „SG“ if no exemptions will be used (Annex II, part 1 will be fulfilled) and if the special purpose can be shown.

For each individual vehicle (vehicle identification number (VIN)) a test report with reference on article 44 of Regulation (EU) 2018/858 and according to annex II, part I, appendix 2, number 2.4 of Regulation (EU) 2018/858 has to be used.

The place and date of testing has to be named. The signed person has to confirm that the vehicle was tested at this place and time physically, that the description of the vehicle is correct and that the vehicle fulfills the requirements according to list of applicable regulations.

It is possible to link to another test report (for example test report for another EU individual approval) and the list of applicable regulations of this test report.

If alternative requirements according to annex II, part I, appendix 2, part I or II are used and if the regulation allows different alternatives, the chosen alternative has to be named (for example: Number 10A, 14A, 15A, 19A, 53Aund 54A)

Which national emission code has to be used if for vehicles of categories M1 and N1 alternative requirements were used?

If in 2A or 41A of annex II, part I, appendix 2, part I alternative requirements are used, the national emission code is determined according to

The national emission code is determined by technical service during vehicle test.

Please consider the following:

For each individual vehicle (vehicle identification number (VIN)) a test report with new test report number has to be written. The place and date of testing has to be named. The signed person has to confirm that the vehicle was tested at this place and time physically, that the description of the vehicle is correct and that the vehicle fulfills the requirements according to list of applicable regulations.
If a conformity declaration of the manufacturer or the test result of a technical service is applicable for other vehicles, a test report can be used multiple times (multi test report)
The multi test report has to get a clear identification code. This identification code has to be named in test report as described in first bullet point and the multi test report has to be added.

Whether the technical features are „approximately“ identically will be decided by KBA in time.

For processing the starting data a fee about 59 Euro has to be paid.

The fees for granting an EU individual approval are about 396 Euro. If at the same time an „approximately“ identically vehicle should be granted, this vehicle causes a fee of 55 Euro.

If an approval has to be refused the fee is about 25 up to 75 percent of the granting fees.

Is or was the vehicle at date of application less than 6 month registrated (registrated means an unlimited, limited or short time approval by an authority to be part of the road traffic, which also includes the identification and allocation of a license plate), this can be shown by a copy of registration documents. If no registration documents are available, it can be also shown by a document about date of production or date of first sale. In this case the date of production or date of sale has to be no longer than 6 month ago.

No, if the vehicle was already registered once.

If the vehicle was not initially registered by Dec. 31, 2020, you could be affected.

Each vehicle is accompanied by an EC Certificate Of Conformity (COC). The exhaust gas level is coded under number 47 or 48.
As of 01.01.2021, vehicles with the exhaust gas codes AM and DG may only be brought to the initial registration with a special permit.

In Germany, the Kraftfahrt-Bundesamt (KBA) issues this approval.

The vehicle must have been in the European Union before 31.12.2021. Furthermore, the vehicle must have an EC certificate of conformity issued before 31.12.2021.

Submit the application, the manufacturer's certificate completed by the manufacturer, the proof of purchase and the EC certificate of conformity to the KBA.

With the limited approval, a vehicle may be registered for the first time until 31.12.2021. It is recommended to submit the complete application documents to the KBA by 22.10.2021.

Despite fulfillment of the application requirements and submission of complete application documents, the application may be rejected. This is the case if the unit limits set by the European legislator are reached.

With the limited approval, you can register the vehicle in Germany for the first time until 31.12.2021. You must present the exemption permit to the responsible registration authority when registering the vehicle.

The limited approval costs 234 euros per application for 1-10 vehicle(s). From the 11th vehicle, 23.40 euros are added for each additional vehicle.

The vehicle's certificate of conformity issued by the vehicle manufacturer is no longer valid for the purposes of first placing on the market if no emission key permitted for first registration is shown.

The type-approval holder must inform the KBA when there has been a change in the legal entity, the name and/or the place of residence of the production plant, whether legally dependent or legally independent production plants.

It is basic that the applicant decides on according to which rule he or she applies for.

National regulations are no longer to be used for technical facts that have been completely harmonized as European regulations.

The KBA must be timely informed on the threatened insolvency.

The KBA must be informed at the latest on the opening of the insolvency procedure. During the insolvency proceedings, the KBA further provides new type-approvals and extensions. The application for these must be made via the legally appointed insolvency administrator. The type-approval will be first sent to the type-approval holder after the receipt of the approval charges.

The existence of a type-approval is bound to the existence of a legal entity (type-approval holder). If the legal entity (type-approval holder) is no longer existent after the closing of the insolvency proceedings, the type-approval becomes invalid.

The KBA must be timely informed on such changes. The company must prove that the type-approval holder up to now has only be renamed or converted. The presentation of an actual official registration document (commercial register excerpt, for example) can confirm that the legal entity further exists.

The validity of a type-approval is bound to the existence of the legal entity (type-approval holder). It is fundamental, that type-approvals cannot be transferred. It is essential to inform the KBA early in such a case, so that it can be examined if there is a legal successor. The type-approval can only remain valid when the legal entity is maintained.

These storage times are only valid for the relationship between the type approval holder and the KBA. They do not replace any legal requirements from other regulations nor stipulations of contracts (e.g. suppliers-OEM).

How a approval mark must look is determined by the selected rule. When there are uncertainties as to the appearance, the intended approval mark should be submitted together with the application documents.

A quick grant of approval requires complete and error-free documents.

If these conditions are met, the KBA aims for an average approval period of 14 calendar days.

KBA is the only type-approval authority in Germany. There are further type-approval authorities in states of the European Economic Area (EEA) and the user states of the ECE regulations.

The KBA is working on commented versions of the Straßenverkehrs-Zulassungs-Ordnung (StVZO - German law for authorization of vehicles for road traffic) and FEE Fahrzeugtechnik EWG/ECE edition published by the German “Kirschbaum Verlag” (only German). The KBA does not know of any other commented versions.

The fee is calculated according to the scale to Gebührenordnung für Maßnahmen im Straßenverkehr (GebOSt - scale of fees for road traffic measures).

In case of national type approvals for vehicle parts according §§ 22 (Allgemeine Betriebserlaubnis (ABE)) or 22a Road Traffic Licensing Code (StVZO) (Allgemeine Bauartgenehmigung (ABG)), the approval holder shall attach a copy of the type approval to the end-user.

The approval holder must provide information on the installation conditions and the restrictions of use in case of national and international type approvals for vehicle parts.

The type-approval holder must always manufacture in conformity with the type-approval. When changes are made to a product, he or she must apply to the KBA for an extension of the type-approval. He or she must also inform the KBA on planned changes in data which are the basis of the type-approval or in the data given in the application procedure.

The KBA randomly checks whether or how the duties are adhered to (conformity check).

When the KBA has knowledge of whether production is temporarily or permanently closed down, all participants save expenditure and costs (e.g. the taking of products for conformity testing).

The KBA must be informed immediately when the production is permanently closed down.

Test samples are only to be kept when they are for type-approval obligatory parts (refer to § 22a Road Traffic Licensing Code (StVZO).

When nothing else is determined in the type-approval, the storage time is 5 years from the extinction of the type-approval.

Type designation is a technical term of the type-approval regulations. Type defines a certain technical specification of a product to be approved well. How different the technical specification of a product within a type can be is regulated by the chosen rule. The limits of a type are regulated by the so-called type defining criteria.

There can be several versions within a type.

The applicant can determine the designations of the type and the versions.

Type designations used for sales purposes are frequently not sufficient for the requirements of the type from the rules and regulations of the type-approval procedure. It is therefore seldom appropriate to use sales designations as type designation.

The type-approval becomes invalid.

A transfer to another company is possible under some conditions. It is essential to integrate the KBA early in such a case otherwise the type-approval will become invalid.

National type approvals to §§ 22 (Allgemeine Betriebserlaubnis (ABE) or 22a Road Traffic Licensing Code (StVZO) are recognized in Germany. Whether they are recognised in another State must be verified by the approval holder in the respective State.

Type approvals according to international regulations are recognized in the European Economic Area (EEA) and in the user states of the respective ECE regulations.

A type-approval always relates to the approval of a large number of products of the same type. Based on a type-approval the type approval holder can produce any number of identical products.

In contrast to this, individual approvals always relate to one concrete vehicle or component part.

A distinction is made between three types of type-approvals. These are type-approvals for vehicles, systems and components (separate technical units).

These type-approvals are granted according to different Regulations.

A difference must be made between three types of regulations, the national regulations (Road Traffic Licensing Code (StVZO), Vehicle Parts Ordinance (FzTV)), the regulations for the EU and the regulations of the UN-ECE (ECE regulations).

The number of the type-approval can pre-approved.

It requires a completed initial assessment.

An application for type-approval must be submitted in addition to the application for the pre-approval of the the number.

Type-approvals for components can be issued according to national regulations (§§ 22 or 22a Road Traffic Licensing Code (StVZO), according to regulations for the European Economic Area (EEA) (EC directives and EC/EU regulations) as well as according to the regulations of the UN-ECE (ECE regulations).

Vehicle type-approvals can be issued according to national regulations (§ 20 Road Traffic Licensing Code (StVZO) or EU regulations (Directives 167/2013, 168/2013 and 2018/858 as well as previous directives).

Type-approvals for systems can be issued according to regulations for the European Economic Area (EEA) (EC directives and EC/EU regulations) as well as according to the regulations of the UN-ECE (ECE regulations).

A system means an assembly of devices combined to perform one or more specific functions in a vehicle and which is subject to the requirements of an international regulation.

Examples of systems are the braking or steering system of a vehicle or the mounting of wheels and tyres.

On the page "Designated bodies" you will find lists of all technical services notified by the KBA, prepared according to various aspects, with details of the scope of the notification. After the notification, the designated technical services will also be published on the EU and UNECE websites.

The technical service must be designated by the KBA according to the relevant test procedure (the relative scope).

Type-approvals are frequently prescribed by the legislator. In such cases, they make access to the market in Germany, the European Economic Area (EEA) and further states possible for the manufacturer.
