According to this legal basis, the data must be transmitted if the recipient, stating the license plate number or vehicle identification number in question, demonstrates that he or she requires the data to assert, secure or enforce or to satisfy or defend legal claims in connection with participation in road traffic or to bring a private action for violations committed in road traffic.
Furthermore, the time of the damage event (event date) must be stated so that in the event of a change of owner in the meantime it is clear which vehicle owner is to be claimed against.
Presentation means plausible assertion, acceptable explanation, coherent and contradiction-free description of a fact from which the conditions for issuing information can arise.
Participation in road traffic may be active or passive (perpetrator, injurer, victim, injured party, etc.). An indirect connection with participation in road traffic is sufficient. However, the participation must have a relation to the road traffic event. This is particularly the case if the motor vehicle is in use. However, participation in road traffic can also exist if the motor vehicle is parked. The use of the motor vehicle does not necessarily have to take place on public roads. It is sufficient if the vehicle is parked in a private parking lot or garage and the vehicle causes or suffers damage there, for example, or if the use of the vehicle infringes the rights of others (e. g. ownership, possession of the property).
